Delhi man seeks ₹2.05 crore over alleged Khan Market smart-glasses recording

A Delhi man has sent Meta and an Instagram creator a legal notice seeking ₹2.05 crore in damages over an alleged recording at a Costa Coffee outlet in Khan Market that was later posted as an Instagram Reel.

The notice, sent on August 24 through advocate Apar Gupta with legal assistance from the Internet Freedom Foundation, says the man was sitting alone when the creator approached him and continued speaking with him. According to the notice, he complained to café staff and moved within the outlet without knowing that the interaction was allegedly being recorded using Ray-Ban Meta smart glasses. The notice also alleges that people accompanying the creator filmed from other angles.

According to the notice, the Reel was uploaded on July 26. The man reported it to Instagram the following day under bullying and harassment, saying the platform did not offer a privacy-violation reporting option. He also complained to Meta’s India grievance officer. The notice says Instagram did not remove the video.

The notice seeks removal of the Reel, an apology, and preservation and disclosure of material connected to its recording and publication. It also questions whether the glasses’ recording indicator gives people nearby sufficient notice. The allegations and any liability of Meta or the creator have not been decided by a court.
