
The Haryana town and country planning department has rejected AIPL’s challenge to the licence and change-of-developer approval for a Sector 58 project, keeping the existing approvals in place.
DTCP passed its order on August 13 after the Punjab and Haryana High Court asked it to decide AIPL’s representation following hearings with the parties involved. The department found no grounds to cancel licence number 69 of 2025, the parent licences or the change-of-developer approval.
A 14.8-acre project in Gurgaon’s Sector 58 will retain its existing development approvals after the department of town and country planning rejected a challenge by Advance India Projects (AIPL).
DTCP’s August 13 order followed a July 7 Punjab and Haryana High Court direction to decide AIPL’s representation after hearing stakeholders, including Commander Realtors, IREO-related entities and Oberoi Realty. The court had temporarily barred further allotments and the creation of third-party rights until that representation was decided.
AIPL had sought cancellation of licence number 69 of 2025, earlier licences and the approval for a change of developer. It cited a 2021 memorandum of understanding and raised objections over project completion, foreign investment and investigations involving IREO entities.
DTCP said its records showed no defect in title when the original licences were granted, migrated and transferred. It found the approval process complied with Haryana’s urban-areas law, 1976 rules and applicable policies. The department also said the land was not covered by an Enforcement Directorate provisional attachment order and found no violation of the applicable foreign-direct-investment policy.
For prospective buyers, the order means the project’s licensing approvals remain valid. Oberoi Realty said the court’s interim restriction ended with DTCP’s decision.
