Khan Market café recording prompts legal notice to Meta and Instagram creator

A July 24 interaction at a Khan Market café has led to a legal notice against Meta and an unnamed Instagram creator over a reel allegedly recorded with camera-equipped smart glasses.

The notice, sent on August 24 by lawyer Apar Gupta, says the Delhi resident was alone when a stranger approached him with unsolicited questions and followed him after he changed seats. It alleges the encounter was recorded without his knowledge and posted two days later on a verified Instagram account with more than 200,000 followers.

The notice says the video drew more than 419,000 views, 15,700 likes and over 500 comments by August 6. It alleges that the resident reported the reel under bullying because Instagram offered no specific reporting category for non-consensual recording, and that Meta twice found it did not breach its community standards.

It seeks removal of the video, a public apology, disclosure of everyone involved in recording it, and preservation of metadata. Meta said its glasses have a recording LED that cannot be switched off and disable recording if the light is tampered with. No court petition has been filed.
