Noida SI suspended after ₹5 lakh peace-bond notice to Gautam Buddha University student is cancelled

Akshat Tripathi, a Gautam Buddha University student, was asked on September 4 to explain why he should not furnish a ₹5 lakh personal bond and two sureties of the same amount to maintain peace for six months.

The notice under Section 130 of the Bharatiya Nyaya Suraksha Sanhita followed a report by Ecotech-1 police station sub-inspector Shiva Yadav. The report alleged that Tripathi was circulating false anti-government statements and instigating others to join a CJP protest, potentially causing unrest.

Gautam Budh Nagar Police said Yadav was suspended on Wednesday night and that a departmental inquiry had begun into officers involved in the matter. On the night of September 4, police said, the SI submitted another report saying the information received was false. The executive magistrate’s order was cancelled on September 5.

Tripathi later approached the Supreme Court, which questioned the Gautam Budh Nagar administration over issuance of the notice despite earlier directions against coercive action against students. Police said no suspension order had been issued against the executive magistrate.

The administration said BNSS powers had been transferred to police under the commissionerate system, and that the district magistrate could no longer issue orders under the BNSS or the earlier CrPC.
